By accessing or using Binary Hub's website and applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Use of Services

Scope of License

Binary Hub grants you a limited, non-exclusive, non-transferable, revocable licence to use our applications solely for your personal, non-commercial purposes (unless otherwise agreed in writing). This licence does not include the right to:

  • Modify or create derivative works based on the application
  • Use the application for any commercial purpose without a separate agreement

This licence is effective until terminated by you or Binary Hub. Your rights under this licence will terminate automatically if you fail to comply with any of these terms.

This licence applies to all Binary Hub applications including Running Records Calculator, SPICE, Teach Pad, and Task Star. Binary Hub is solely responsible for the content and functionality of these applications.

Intellectual Property

All content, designs, code, graphics, and trademarks displayed on our website and within our applications are the property of Binary Hub or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

User-generated content (such as data entered into our applications) remains your property. By using our services, you grant Binary Hub only the technical permissions necessary to provide the service (e.g., storing your data on your device or via iCloud sync).

Limitation of Liability

To the maximum extent permitted by Australian law, Binary Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

This limitation applies to all Binary Hub applications (Running Records Calculator, SPICE, Teach Pad, and Task Star) and services.

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

In no event shall Binary Hub's total liability exceed the amount paid by you (if any) for the application or service in the twelve (12) months preceding the claim.

Maintenance and Support

Binary Hub is not obligated to provide maintenance, technical support, or updates for its applications (Running Records Calculator, SPICE, Teach Pad, and Task Star). Any maintenance or support provided is at Binary Hub's sole discretion.

Third-Party Intellectual Property Claims

In the event of any third-party claim that our applications (Running Records Calculator, SPICE, Teach Pad, or Task Star) or your possession and use thereof infringes a third party's intellectual property rights, Binary Hub shall be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
